DIVORCE In North Carolina, a married couple must be separated for one year before a request for a divorce can be made. The couple must live under two separate roofs continuously for one year, with the intent by at least one spouse to end the marriage to obtain a divorce. Property division and spousal support will be waived if they are not fully resolved before the divorce is granted or asked for through a lawsuit.
SEPARATION A Separation Agreement is a legal contract between a Husband and Wife resolving issues such as property distribution, custody, child support and spousal support. A Separation Agreement must be notarized.
